New FOI Rules for Government Contracts    2 Feb, 2005

The Freedom of Information (Miscellaneous) Amendment Act 2004, which came into effect on 1 January 2005, contains several important amendments to the Freedom of Information Act 1991 ("the FOI Act"), some of which relate specifically to Government contracts.

The effect of these amendment is that Government contracts will now be more readily accessible under the FOI Act, due to the following new provisions:

  • the Business Affairs Exemption in clause 7 of Schedule 1 of the FOI Act has been amended by the addition of a new sub-clause 7(3):and
  • the Confidential Information Exemption in clause 13 of Schedule 1 of the FOI Act has been amended by the addition of new sub-clauses 13(2) to 13(7).

The Amending Act also contains other amendments which do not relate to specifically Government contracts and which are not referred to in this advertisement.
